WESTPORT — A Shelton man was charged with driving under the influence in Westport after his car rolled over on Wilton Road, police said.

On Nov. 8 around 7:15 p.m., officers responded to report of a rollover accident on Wilton Road and, upon arrival, found two passengers were outside the car and uninjured. The driver, later identified as Warren Fix, 55, required extrication by the Westport Fire Department, police said.

Fix was traveling southbound on Wilton Road when he attempted to pass the car in front of him that was waiting to turn left on Christmas Lake Lane. Fix crossed over the double yellow line and passed the car on the left, striking the front of the other car as it attempted to make a left turn, police said.

In speaking with Fix, the investigating officer smelled an odor of alcoholic beverage on his breath and then transported him to the hospital for evaluation. A search warrant application for Fix’s hospital blood test results was submitted, and Fix was found to have cannabis in his system and a blood alcohol content above the legal limit at the time of the accident, police said.

Police submitted a warrant for Fix’s arrest and on Dec. 1, he turned himself in at headquartere. Fix was charged with operating under the influence of drugs/alcohol and improper passing/safe distance/cutting in. Fix was released on a promise to appear and is scheduled to appear in state Superior Court in Norwalk on Dec. 11.
